{"id":6225,"date":"2012-02-03T12:47:33","date_gmt":"2012-02-03T16:47:33","guid":{"rendered":"http:\/\/wayneandwax.com\/?p=6225"},"modified":"2015-01-07T13:38:42","modified_gmt":"2015-01-07T17:38:42","slug":"megaupyours","status":"publish","type":"post","link":"https:\/\/wayneandwax.com\/?p=6225","title":{"rendered":"Mega Uh-Oh"},"content":{"rendered":"<p><img decoding=\"async\" src=\"http:\/\/wayneandwax.com\/wp\/images\/megaupload-endorsements.jpg\" width=600><\/p>\n<p>I&#8217;ve got a piece in this week&#8217;s Boston Phoenix discussing the spectacular shuttering of Megaupload and the collateral damage produced by an increasingly aggressive copyright regime in tandem with a remarkable nonchalance about preserving the digital libraries we build. Some will recognize this as but the latest instance of <a href=\"http:\/\/wayneandwax.com\/?p=2913\">platform politricks<\/a>, just another rug yanked out from under folks tryna dance with each other. (Though it looks like another series of <em><a href=\"http:\/\/wayneandwax.com\/?p=4824\">SoundClowns<\/a><\/em> may be <a href=\"http:\/\/www.jossmolders.nl\/?p=2846\">on its way<\/a>!)<\/p>\n<p>Anyway, <strong><a href=\"http:\/\/thephoenix.com\/Boston\/news\/133447-mega-up-yours\/\">check it out<\/a><\/strong> and tell me what you think. Shouts to <a href=\"https:\/\/twitter.com\/#!\/carlycarioli\">Carly Carioli<\/a> for reaching out about the piece and, along with Sara Rosenbaum, helping to whittle it down into something pretty darn sharp, if I say so.<\/p>\n<p>As for this space, allow me to share a few linked-up grafs below that ended up on the cutting room floor, as well as some germane and entertaining media: <\/p>\n<blockquote><p>As with its predecessors, the sudden shuttering of Megaupload leaves a whole lot of holes in the e-ther. Among other random disappearances to tick across my timeline: the only copy of a personal video a friend\u2019s father had recently stored there; and the sole upload of <em>Nehru Jackets<\/em>, the acclaimed new mixtape from Himanshu Suri of Das Racist (at least until a few hours later, as <a href=\"https:\/\/twitter.com\/#!\/dasracist\/statuses\/160694064692461569\">Suri\u2019s supporters<\/a> quickly re-upped the zipfile to similar sites). No doubt thousands of other innocent files were disappeared on January 19, but none are likely to get their day in court.<\/p>\n<p>Of course, it\u2019s hard to sympathize with anyone who\u2019s thinking is so clouded that they would entrust their only copy of something to a service that <a href=\"http:\/\/popcrush.com\/department-justice-megaupload-users-deleted-terms-service\/\">explicitly warned<\/a>, in both its ToS and FAQ, of the possibility of complete data loss (with no liability on their part). And it\u2019s even harder to sympathize with Kim Dotcom, the cartoonish founder of Megaupload. So apparently full of money, food, and hubris is Dotcom that Hollywood could hardly hope to cast a better villain. Indeed, few embody the foreign rogue in the crosshairs of SOPA and PIPA as well as Dotcom with his <a href=\"http:\/\/www.vice.com\/read\/we-read-the-megaupload-indictment-papers-so-you-don-t-have-to-1\">extravagant nose-thumbing<\/a> at the MPAA and RIAA \u2013 never mind <a href=\"https:\/\/en.wikipedia.org\/wiki\/Kim_Dotcom\">prior convictions<\/a> for computer fraud, insider trading, and embezzlement.<\/p>\n<p>But if Dotcom comes across as an odious parasite, it\u2019s telling that many seem to prefer him as their middleman over more established gatekeepers. In the weeks before it was shut down, Megaupload had been getting under the skin of the recording industry not simply because of piracy; rather, the site was becoming a special thorn in the side because some of the industry\u2019s marquee artists were publicly endorsing it. A <a href=\"http:\/\/vimeo.com\/33424808\">promotional song and video<\/a> (see below) featuring testimonials from the likes of Kanye West, will.i.am, Lil Jon, and Sean Combs began to make the rounds, as did rumors that producer Swizz Beatz had become CEO of the company. In the wake of the raid, <a href=\"http:\/\/www.techdirt.com\/articles\/20120120\/15060817494\/busta-rhymes-backs-megaupload-says-record-labels-are-real-criminals.shtml\">Busta Rhymes took to Twitter<\/a> to defend Swizz Beatz and Megaupload alike, arguing that the site offered a more promising and direct revenue stream to artists than Spotify. <\/p>\n<p><iframe loading=\"lazy\" src=\"http:\/\/player.vimeo.com\/video\/33424808?title=0&amp;byline=0&amp;portrait=0\" width=\"500\" height=\"281\" frameborder=\"0\" webkitAllowFullScreen mozallowfullscreen allowFullScreen><\/iframe><\/p>\n<p>Even if Megaupload was an obvious target, that doesn\u2019t make it easier to hear the pathetic giant paper-crumpling sound of thousands of non-infringing files disappearing behind a JPG of <a href=\"https:\/\/en.wikipedia.org\/wiki\/File:NIPRCC-logo.PNG\">an eagle carrying a bad pun in its talons<\/a>.
